NCLT lets SpiceJet lessor withdraw IBC plea, imposes ₹15 lakh costs
The National Company Law Tribunal permitted lessor Aviator ML 29641 Limited to unconditionally withdraw its Section 9 insolvency plea alleging Rs 58.64 crore default against SpiceJet Limited after an overnight settlement involving an initial payment of $500,000. The tribunal imposed joint costs of Rs 15 lakh, with SpiceJet Limited and the lessor to pay Rs 7.5 lakh each, and declined to record settlement terms or a revival clause. It withdrew reserved orders in seven other connected petitions against SpiceJet Limited for fresh consideration before the regular Bench. SpiceJet Limited welcomed the disposal as a positive step.
